Welcome to Coffee Warehouse. These Terms & Conditions ("Terms") govern your access to and use of the website coffeewarehouse.ca (the "Site") and the purchase of any products or services offered by Coffee Warehouse ("we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Eligibility

You must be at least the age of majority in your province or territory of residence, or accessing the Site under the supervision of a parent or legal guardian, to use the Site or make a purchase. By using the Site, you represent that the information you provide is accurate, current, and complete.

Accounts

You may be required to create an account to access certain features or complete a purchase. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

Products, Pricing & Availability

We make every effort to display our products and their descriptions, images, and pricing accurately. However, we do not warrant that product descriptions, colours, pricing, or other content are error-free. All products are subject to availability, and we reserve the right to discontinue any product at any time. Prices are shown in Canadian dollars (CAD) unless otherwise stated and are subject to change without notice.

In the event a product is listed at an incorrect price or with incorrect information due to a typographical or system error, we reserve the right to refuse or cancel any order placed for that product, whether or not the order has been confirmed and payment processed.

Orders & Acceptance

Your submission of an order constitutes an offer to purchase. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or suspected fraudulent activity. If we cancel an order after payment has been processed, we will issue a refund to your original method of payment.

Payment

You agree to provide current, complete, and accurate payment information for all orders. Payment is processed through trusted third-party payment processors, and by placing an order you authorize us to charge your selected payment method for the total amount, including applicable taxes and shipping. Applicable sales taxes (GST/HST/PST) will be added at checkout based on your shipping destination.

Shipping & Delivery

We will make reasonable efforts to ship products within the estimated timeframes displayed at checkout; however, delivery dates are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other events beyond our control. Risk of loss and title for products pass to you upon delivery to the carrier.

Returns, Refunds & Exchanges

If you are not satisfied with your purchase, please contact us to discuss a return, exchange, or refund. Certain items, including perishable goods such as coffee and food products, may not be eligible for return once opened, for health and safety reasons. Where a return is accepted, products must be unused and in their original packaging. Refunds, where applicable, will be issued to the original method of payment. SMS/Text Messaging

By opting in to SMS from a web form or other medium, you agree to receive SMS messages from Coffee Warehouse. These messages may include order alerts and confirmations, shipping and delivery updates, account notifications, customer service replies, and—where you have opted in—promotions and special offers. Message frequency may vary. Message and data rates may apply.

Promotions & Discounts

Any promotions, discount codes, or special offers are subject to their own terms, may be modified or withdrawn at any time, cannot be combined unless expressly stated, and have no cash value. We reserve the right to cancel orders where a promotion has been used in a manner that violates its terms or these Terms.

Intellectual Property

All content on the Site—including text, graphics, logos, images, product descriptions, and the compilation thereof—is the property of Coffee Warehouse or its content suppliers and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or otherwise use any content from the Site without our prior written permission.

Acceptable Use

You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, or impair the Site. Prohibited activities include, but are not limited to, attempting to gain unauthorized access to any portion of the Site, interfering with its security features, transmitting harmful code, or using automated systems to access or scrape the Site without our permission.

User Content & Reviews

If you submit reviews, comments, or other content to the Site, you grant us a non-exclusive, royalty-free, perpetual, and worldwide licence to use, reproduce, and display that content in connection with our business. You are solely responsible for the content you submit and represent that it does not violate the rights of any third party or any applicable law. We reserve the right to remove any content at our discretion.

Limitation of Liability

To the fullest extent permitted by law, Coffee Warehouse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site or any products purchased. These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada, for the resolution of any disputes.
